Object

These General Conditions of Sale (hereinafter the "General Conditions") aim to govern the conditions under which the service Max It (hereinafter the "Service") accessible on the website topup.orange.com / https://maxit.orange.com (hereinafter the "Site") is offered to any user (hereinafter the "Customer"). This Service allows the Customer (i) to transfer communication credit for topping up prepaid mobile accounts or (ii) to recharge an Orange Energie subscription, corresponding to the usage in days of a Solar Kit.

They define the conditions under which Orange Link provides the Service to the Customer, and the conditions under which the Customer recharges the account(s) of a Beneficiary for mobile or Orange Energie prepaid accounts of Beneficiaries from various countries worldwide, where mobile operators partnering with the Orange Top Up / Transfer Country Service are present. The recharge of the Beneficiary's mobile or Orange Energie prepaid account is carried out immediately.

By using the credit transfer Service for topping up prepaid mobile accounts or remote recharge of the Orange Energie offer for a prepaid Orange Energie account, as well as any use of the Site, the Customer fully and unreservedly accepts these General Conditions of Sale. These Conditions may be modified at any time.

 

Definitions

Service: The Service is the Orange Top Up / Max It service that allows the Customer, for a Beneficiary, who is a client of the partner mobile operators, to:

- transfer telecommunication credits for prepaid mobile recharge; - purchase remotely a recharge for an Orange Energie prepaid account.

These services are offered to the Customer via the website accessible online at: topup.orange.com / maxit.orange.com

Customer: The Customer is the person who orders and pays for the Service to recharge prepaid mobile credit or Orange Energie Kit on behalf of a Beneficiary.

Beneficiary: The Beneficiary is the person for whom the recharge is made by the Customer via the Service. The Beneficiary holds a prepaid mobile account or a prepaid Orange Energie account with one of the partner mobile operators of the Service. The Beneficiary is individually identified by a phone number in international format (+country code + phone number) or by the identifier number of their Orange Energie Account.

Partner mobile operator of the Service: A partner mobile operator is a mobile communication operator with whom Orange Link SAS has the technical means and contractual agreements to perform recharge of mobile accounts and prepaid Orange Energie accounts under the conditions of the GTC. The current list of partner mobile operators is available on the Site.

Telecommunication Credit: The Credit is a telecommunication credit transferred as a recharge to the Beneficiary's prepaid mobile account within the scope of the Service. A Credit is defined by an amount expressed in mobile communication credit units: for most partner mobile operators, the credit unit is the local currency of the country where the Operator operates. This amount, hereinafter referred to as "Face Value," corresponds to the recharge that is actually credited and available on the Beneficiary's mobile account.

Orange Energie Credit: The Orange Energie Credit is a service offered to the Customer involving the remote purchase of an Orange Energie recharge for an Operator subscriber, transferred as a recharge to the Beneficiary's prepaid Orange Energie account. An Orange Energie Account is defined as an account under which a Customer makes a payment to Orange Link to recharge an Orange Energie account of a final customer of the operator, who holds a valid such account and has been previously designated by the Customer. This Beneficiary is a subscriber of the Operator who has subscribed to an Orange Energie offer and benefits from the services purchased by the Customer and provided by the Operator. The recharge amount, expressed in the local currency, corresponds to the duration of use of the Solar Kit (indicated in days of use). This amount, hereinafter called "Face Value," is the recharge that is actually credited and available on the Beneficiary's Orange Energie account.

Recharge: The value of telecommunication credit or Orange Energie Credit purchased by the Customer for a Beneficiary.

 

Description and Modalities of the Service

Orange Link SAS does not provide telecommunication services or subscription services for the use of an Orange Energie Kit. It is solely a reseller of telecommunication credits from mobile operators and Solar Kit recharges from partner mobile operators for the purpose of recharging mobile and prepaid Orange Energie accounts of Beneficiaries, who are clients of these operators. Orange Link SAS does not provide end-to-end service; the recharge process is carried out by the telecommunication mobile operator.

The telecommunication credits and Orange Energie recharge credits from these mobile operators are transferred to the Beneficiaries, subscribers of the Operator, without recourse against Orange Link SAS in case of failure by the mobile operator. Disputes related to service quality, minutes, or other telecommunication services provided by the Operator, costs, validity period, or other conditions of the transferred credits or recharges must be addressed directly with the partner mobile operator. The Operator provides a 24/7 telephone support service for Beneficiaries.

The Operator sends the Beneficiary an SMS or similar confirmation once the service is completed.

 

Recharge, Order, and Payment Conditions

4.1. Recharge Conditions

The website only allows recharging prepaid accounts of mobile operators accepting this service and having an agreement with Orange Link SAS. The list of accepting operators may change without notice, and is published on the Site. The list of territories and mobile network operators may also be modified.

The recharge has no monetary value. It is neither exchangeable nor refundable. The number of call minutes varies depending on the tariff conditions and offers, as do the durations of Orange Energie recharges, which depend on the subscription type and conditions of each recipient operator. The indicated recharge amount may also change without notice following modifications by the recipient operators. The recipient operator may also apply various fees, taxes, or charges without notice, which could reduce the credit amount in relation to the face value of the recharge at any time. Orange Link SAS is not responsible for these conditions or modifications made by the recipient operator.

The recharge value may be subject to modifications according to the general conditions of the partner mobile operator. Orange Link SAS is not responsible for these conditions or any changes thereof.

Once the credit is loaded onto the Beneficiary's mobile account or the Orange Energie account is recharged, the use of telecommunication credit or the Solar Kit is governed by the existing contractual terms between the Beneficiary and the mobile operator. The validity period of each recharge is defined by the mobile operator.

4.2. Order Process

As an intermediary, Orange Link SAS handles the Customer's order for recharges of the Beneficiary's account. The Customer is provided with an online recharge order interface on the Site, which has the following features:

    – The Customer selects a country from the list where the operators operate;

    – The Customer then enters the Beneficiary's phone number or Orange Energie account identifier in international format (+country code + number), selects a recharge amount from the list provided by Orange Link, and the total price including taxes is displayed. The Customer then provides payment details as described in Article 4.3.

The Customer confirms the order by clicking "Confirm" to purchase the recharge. This action authorizes Orange Link SAS to credit the Beneficiary's mobile or Orange Energie prepaid account. Payment by card is irrevocable. By providing banking details, the Customer authorizes the Seller to debit their card for the specified amount. The Customer confirms they are the legal cardholder and authorized to use the card. If an error occurs or the card cannot be debited, the sale is automatically canceled and the order voided.

Once confirmed, Orange Link SAS proceeds to debit the Customer and recharge the Beneficiary's account. The recharge is final; no refunds or exchanges are possible. The Customer is responsible for accurately entering the Beneficiary's phone number or account identifier. Orange Link SAS is not responsible for incorrect transaction validation to wrong recipient numbers. The Customer must ensure the correctness of the Beneficiary's mobile number and Orange Energie account details.

An automatic confirmation SMS is sent to the Customer's registered phone number.

 

Payment Conditions and Modalities

Payment must be made by credit card or other methods specified on the Site. Payment methods may be changed at Orange Link SAS's discretion.

Orange Link SAS reserves the right to reject a Customer's order if payment issues arise.

 

Prices

Prices listed on the Site, inclusive of all taxes, are those in effect at the time of consultation and order validation. The content and prices of offers may change depending on the evolution of the operators' offers and currency fluctuations in the countries where operators operate.

 

Limitations

The Customer is informed that Orange Link SAS applies usage rules, including:

– Maximum amount per day: €220
– Maximum amount per month: €330
– Number of transactions per day: 15
– Number of transactions per month: 30
– Card restrictions: IP address/country couple, valid cards: Visa and MasterCard, invalid cards: corporate or commercial cards, systematic authorization cards, e-cards, virtual cards.

Furthermore, Orange Link SAS may suspend service use in case of fraud or attempted fraud, including during credit transfer operations and Orange Energie recharges.

 

Cancellation of a Validated Order

If a credit transfer operation fails after order validation (e.g., invalid mobile account, ineligible Orange Energie account, operator refusal, technical incident), the corresponding Customer order is canceled. The Customer's payment for this order is also canceled. Orange Link SAS notifies the Customer via email of the cancellation and refund status.

 

Waiver of Right of Withdrawal

Since the recharge is an immediately executed service, and in accordance with article L.221-28-1° of the Consumer Code, the Customer expressly waives the right of withdrawal within 14 days once the Beneficiary begins using the recharge.

Acceptance of immediate service commencement and explicit waiver of withdrawal occurs upon order validation. Purchases of credits are final and non-refundable, and no right of withdrawal applies.

 

Liability

Orange Link SAS and the Operator ("Providers") will make their best efforts to ensure the Service's availability and quality. They aim to keep the Service accessible 24/7. However, they reserve the right to temporarily suspend access without notice for maintenance or technical reasons, without liability. They implement necessary measures to maintain service continuity and quality. Their liability is limited in case of force majeure or damages not directly caused by their fault. They are not responsible for indirect damages, including loss of business or commercial prejudice. Their liability is limited to the amount paid for the service in case of contractual breach.

The site is generally available 24/7 but may be temporarily suspended for maintenance.

Orange Link SAS does not provide telecommunication or Solar Kit subscription services. It acts solely as a reseller of telecommunication recharges and Solar Kit recharges. Performance and continuity of services provided by mobile operators are not guaranteed by Orange Link SAS.

 

Registration

To benefit from the Service, the Customer must create their own account.

During registration, the Customer must provide accurate, complete, and up-to-date information as requested. The Customer certifies that the information is correct and agrees to update it if necessary.

Once registered, the Customer receives a username and password and is fully responsible for all activities under their account, including unauthorized use of their credit card. The Customer must immediately notify contact@maxitorange.com of any unauthorized use.

The Customer must be of legal age to purchase recharges on the Site. Orange Link SAS is not responsible for misuse by minors or underage users without parental authorization.

 

DabaDoc Consult Voucher

DABADOC, a Moroccan company with a capital of 314,040 MAD, with headquarters at 250 Bd de Bordeaux and Moulay Youssef, No. 6, Casablanca, registered under number 299319, offers an online medical teleconsultation service.
The offer allows the Customer to purchase a DabaDoc Consult voucher to pay for a video medical consultation on the DabaDoc website.
The General Conditions of Sale of DabaDoc apply (see DabaDoc's CGV at https://www.dabadoc.com/conditions-d-utilisation).

The voucher represents a credit that allows the user to acquire services from DabaDoc. It is associated with a face value in currency. In exchange for the used value, DabaDoc commits to providing the service. DabaDoc agrees to credit the Beneficiary's account once they exchange the voucher from their account. The validity period of the voucher is time-limited according to the service and contractual conditions.

Orange Link charges the Customer a transaction fee of €1.83 excluding VAT for the 200 MAD voucher and €4.17 excluding VAT for the 500 MAD voucher.

The complaint must include:

– the country, recharge mobile number, and Orange Energie account identifier of the recipient,
– date and time of the order,
– transaction reference,
– user account identifier,
– detailed reason for the complaint.

 

Access Rights to Files and Personal Data

Orange Link SAS collects personal data when a customer orders the Service (e.g., phone number, email) and the Beneficiary's data (phone number).

This collection allows Orange Link SAS to process the order and improve its services or send information about its services. By using Orange Link SAS services, the Customer agrees to data processing and free commercial offers.

For the execution of this contract, the Beneficiary's mobile phone number and Orange Energie account identifier may be transferred to the Beneficiary's mobile operator, possibly outside the European Union. Data may also be transferred to third-party providers involved in providing the Service.

In accordance with Articles 38, 39, and 40 of Law No. 78-17 of January 6, 1978, amended by Ordinance No. 2018-1125 of December 12, 2018, and Regulation (EU) 2016/679, the Customer has rights of opposition, access, rectification, and deletion of their personal data obtained by Orange Link SAS.

Cookies

We inform the Customer that during their visits to the Site, one or more "cookies" may be installed automatically on their computer. A cookie is a small file stored on the Customer's hard drive. It does not identify the Customer personally but records information about their navigation (pages viewed, date and time, IP address, etc.). Data collected is mainly for statistical purposes. These data are not transmitted to third parties but may be disclosed in case of illicit behavior or judicial request.

 

Applicable Law and Disputes

These General Conditions of Sale are governed by French law.

Subject to the provisions of Article 48 of the New Civil Procedure Code, in case of dispute regarding interpretation, execution, or validity of these conditions, and if amicable resolution fails, jurisdiction is assigned to the Courts of PARIS, regardless of the number of defendants or third-party claims, including in emergency proceedings.
